An Anniversary Award of a Certificate of Recognition and a gift was presented to Bob Hufnagle, Assistant Building Official/Senior Building Inspector, by Mayor Songstad, for 10 years of service to the City of Laguna Hills. Recognition of Ms. Carol Meyers, Parks and Recreations Commissioner, for her outstanding service to the City. Ms. Meyers, who has devoted a great deal of her time to the City, is relocating near Kansas City to be closer to her family. Carol served on the General Plan Advisory Committee for the City's General Plan Update in addition to serving as Vice Chair and Chair on the Parks and Rec. Commission and she helped design Beckenham Park and added the play equipment that has attracted lots of children to make this park so active. Congratulations Carol and we will miss you!

Proclamation of Fire Prevention Week Oct. 9 - Oct. 15, 201. National Fire Protection Association designates one week each year as Fire Prevention Week to commemorate the Great Chicago Fire of 1871. This year's these is "Protect Your Family from Fire." Ron Roberts was present to receive the Proclamation. Ron invited the public to stop by fire station #22, at 24001 Paseo de Valencia, next Saturday, Oct. 15, from 10 am to 3 pm for an Open House.

PUBLIC COMMENTS - Dwayne Cave, Representative from San Diego Gas and Electric recalled that we had a major power outage on Sept. 8, 2011 involving all of So. CA, the Imperial Valley, Arizona and parts of Mexico. He said each quarter SDG&E employees train for emergency situations at their Emergency Operations Center. He noted power was restored to all within 12 hours. He said they are still looking for the causes and that process may take 6 months. He said this event was an eye opening experience for many people for a real emergency. He answered Council Member Lautenschleger that it is normal for the San Onofre Nuclear Power station to automatically shut down as a safety precaution in a situation such as this. He noted that power went out in Also Hills again last Sunday night and returned by about 1:00 in the morning. He said they are still working on a circuit there and replacing some cable to correct the problem. Council Member Bressette said his neighborhood in Aliso Hills looks forward to having their wires replaced so this doesn't happy as often in the future. Bressette asked the City Manager if the City Tweeted to the people who has signed up for that service during the large power outage in Sept.? Channing's response was "Not to my knowledge" because the City's best Tweeter was out on leave. (Editor's Note - Since apparently there is no 2nd best tweeter at the City who could have helped perhaps the City should rethink that service?)

LHHS STUDENT LIAISON REPORT by Kylie West (alternate Jeena Bonutto). -   Home Coming is next week and the big Home Coming Football Game (The Bash Before the Clash) is a week from this Friday against San Juan Hills. LHHS football team undefeated 5 - 0. Also there is Spirit Week next week with all the students dressing up all crazy. Brown and Gold day on Friday with more crazy dressing. On Nov. 3 - 5, the LHHS Drama Program presents The Curious Savage. Tickets for this are at www.LHHSdrama.com Back to School Night is this Thursday. Red Ribbon Week is coming up Oct. 24-28 - the whole school gets involved with this. The WASC accreditation meetings continue and accreditation is good for 6 years. The last accreditation is expiring for LHHS in 2012. Council Member Kogerman noted that accreditation for 6 years speaks very well for LHHS.

Win Win Wednesday this Wednesday Oct. 12 from 4 to 9:30 is Habit Burger (Lake Forest) at El Toro and Rockfield and next week Wed. Oct. 19 is Villa Roma (Laguna Hills) - 11 am to 9 pm La Paz and McIntyre. Wed. Oct. 26 will be On the Border (Aliso Viejo) and will be the first Hawk Alumni mixer, inviting any and all Hawk Alumni/Families to come between 11 am and 9 pm with special encouragement to come between 5 - 7 pm for happy hour because On the Boarder is also giving a portion of the alcohol proceeds to the LHHS PTSA.

The HAWK CHALLANGE Golf Tournament held at the El Niguel Golf Course on November 14 is the single major annual fundraiser event for LHHS PTSA. For information and tickets go to - lhhshawkchallenge@gmail.com . The contact is Deborah Aufill. The tournament needs more golfers at this point. The early bird registration price is $199 including breakfast, lunch, dinner, cart, 18 holes and more. After 10/25 the prices climbs to $225. Non-golfers are invited to the dinner for $50 pre-paid. There is also the 1500 golf balls dropped from a helicopter that could win you $2000 if the ball you pay $10 for falls into the hole.

MINUTES - Recommendation that the City Council Approve the Minutes of the previous City Council Meeting for publication on the city web site. The minutes from tonight's meeting will not be approved for publication until the next city council meeting so there is a long delay for the public related to timely documentation of information from the city.

Item 4.3 Management Agreement with Essex Realty Management, Inc. for Property Management Services of the Laguna Hills Community Center - an approximately 48,000 sq. ft. project. Essex has managed the Laguna Hills City Hall since Sept. of 2001. City Staff Report says Essex is currently managing the Community Center and staff is pleased with the job they have done. Staff's report says maintenance and repair oversight duties of the Community Center were assigned to the Community Services Coordinator who resigned in July to 2011 and rather than replace that position they say the cost for outsourcing the service to Essex's services can be covered by the personnel cost savings from the vacancy left by the Community Services Coordinator. Essex's scope of work will include the hiring and firing and supervision of all service vendors including HVAC, Lighting, Pest Control , Facility Maintenance, Elevator Maintenance and Repair, Floor Maintenance and Window Washing. Essex will provide monthly accounting reports to the City and regular inspections will be performed to address and maintenance or repair needs.

Proposed agreement will begin Oct. 15, 2011 and the annual cost will be $39,000, billed to the City monthly at a flat monthly fee of $3,250 per month. Staff report says the vacated position of the Community Services Coordinator is a personnel savings of $108,000. The Management Agreement under Construction Services states, if Essex is requested to provide Capital Improvement Services Essex would charge a fee of 5% of total capital costs for any job over $2000 and Under Construction Management the agreement states Essex would be paid 5% up to the first $100,000 of improvement cost and 3% on any amounts greater than $100,000 with no fee if the improvement cost is less than $5000 per occurence. If the City chose to hire any of Essex's employees the City would pay $20,000 per employee. Essex will also be seperately compensated for Vendor 1099 forms, Tax Packages, Audits and Quarterly Accounting Report (after sale of Property).

CITY COUNCIL PUBLIC HEARINGS - ADMINISTRATIVE REPORTS -

7.1 - Orange County Peace Officer's Memorial - Request for funds for a new Peace Officer's Memorial presented by City Manager Channing. Staff report says the old memorial, created in 1986 and designed to last for 20 years, is no longer sustainable and a new memorial is to be designed and located at the OC Sheriff's Training Facility in Tustin. Some features will be bronze statues, eternal flame, reflection pools, fountains 3 walls of plaques and names of fallen heroes and those to be added in the future, and a history wall. Staff Recommendation - Authorize request for $7,500. Vote - Passed 5 - 0

7.2- Intent to Vacate Public Service Easements (Tree Pockets) along the SW side of Paseo de Valencia and between Alicia and La Paz. Staff says these areas are no longer of any use to the City so recommends this action for approx. 21 tree pockets about 5 feet wide and 6 feet deep at Sunburst and Alisal Avenues. Residents are requesting a waiver of the $1,500 processing fee for the public service easement vacation processing. This is a 2 step process to notify and then to hold a public hearing. Fiscal Impact to the City about $1,500 of staff time cost. Per Ken Rosenfield, City Engineer/Director of Public Services - Public Hearing to be Nov. 8, 2011 prior to vacating these easements that will become property of the homeowners in "as is" condition. Staff Recommendation - Declare intent to vacate and set a public hearing.

Mayor Pro Tem Carruth inquired about placement of additional screening material to hide inconsistencies in the block walls where these pockets are. Ken Rosenfield noted there could be a problem if homeowners allow these gaps to fill with weeds and trash and noted it might be about $1000 to patch each gap in the larger block wall where the tree pockets were. Council Member Kogerman asked if there were any low interest loans available to homeowners to rebuild gaps in block walls and she asked if homeowners involved were generally approving of this plan to vacate? City Manager Channing stated the application period for money/block grant funds this year has closed but we could look at the next cycle and see if there is any possibility. Ken Rosenfield noted the City has had no response from the homeowners who were all mailed packages about this on Friday (Oct. 7). (Editor's Note - Whoops, Monday, Oct. 10 was a holiday for the post office so today, Tues. Oct. 11, would probably be the first day those homeowners might receive their packages.) Rosenfield continued that there will be publications about this and a follow-up letter about the public hearing.

Mayor Songstad concluded with, "Alright its been moved and seconded. Everybody understand what the action is here? We're setting a public hearing, blah, blah, blah. All in favor" (**Editor's Note - As one member of the audience in the council chambers questioningly repeated to me - "Nothing says I care like "Blah, Blah, Blah." This quote may not be a winning sound bite for Songstad's 2012 re-election campaign but perhaps we now understand why he so often can't be heard by the audience?)
Vote was 5 - 0 in favor of a Public Hearing.

MATTERS PESENTED by MAYOR and CITY COUNCIL MEMBERS -

Council Member Bressette stated October 22, Saturday, is our next low cost pet clinic so has staff considered putting notices in the parks to assist with informing pet owners who are dog walkers and other ways to advertise the event. City Manager Channing responded a post card is being mailed to all licensed pet owners in the City. They should have that in advance of the event and the City is putting advertising on Facebook.  Bressette continued that Fire Prevention Week is also a great opportunity for people to assess their needs for batteries in the smoke and carbon monoxide alarms that are required to be in homes, the batteries in flashlights, check for viable candles for use in power outages, and be prepared just in case San Diego Gas and Electric pulls the plug again.

Council Member Kogerman said she wanted to add that she read a stack of evaluations of Bob Hufnagle, Assistant Building Official/Senior Building Inspector, who was honored tonight for 10 years of service to the City, and 99% of them were not just positive but extremely positive.

Mayor Pro Tem Carruth agreed with Kogerman's comments about Mr. Hufnagle and added that she will really miss Carol Meyers and her committed service to the City for so many activities.

Public Comments - Carol Meyers, who was honored for her service to the City tonight, stated that she's lived here for 21 years and it has been a joy and pleasure to work with everyone at the City. She said she thinks we have a great city and council meetings are really boring because everything runs so well.

P - Item 4.3 - Probably a good taxpayer savings idea to outsource the management of the City's Community Center

I can't believe the safe zones for children in City Parks item was controversial. So what if our City includes HOA's. We didn't ask their permission before passing the no fireworks ordinance or the can't park an RV on the street ordinance. But we need their
permission to protect children from Registered Sex Offenders? I can't even believe Joel's statement. I can't believe that Melody wants to wrap this in with Obamacare. Songstad doesn't see solutions just problems. We looked like idiots to the woman from the DA's office and the woman who is trying to champion this cause.



Regarding the Laguna Hills City Manager's Employment Agreement
Anonymous said... The Employment Agreement for the City Manager does appear to be carefully drafted with Craig Scott's help. The careful crafting of the March renewal date and the June effective date, the 30-month initial term, the passive renewal, the 6-month "cooling off" period and no way to avoid a severance option are extremely advantageous for the City Manager but not for the City and the taxpayers. The mistake or ambiguity over the severance multiplier could be intentional. The 13-month maximum and the reference to multiplying by Channing's monthly salary could be a smokescreen for the option Channing really would take which is to give written notice when the unexpired term is less than 13-months and the multiplier is applied to "base pay" which is an annual number. That way he walks away with more than $2 Million.

Additionally, the Board approved two new policies that enhance the role of your elected officials and is designed to prevent both excessive salaries and an inflated number of top level management positions. The first policy limits the number of discretionary pay raises to a maximum of one per year. The second policy requires Board approval for all new or reallocated executive management positions.

Our City fought vigorously at our expense to protect their total compensation but for us they continue with the long playing old standard of everything in the city is safe and good, no need for any changes, and no need to look at what they're doing because it's all good. Kogerman has brought up issues and helped to do what she can, considering she has so little support from the rest of the council, but we are also not being protected by the County or the State or anywhere that I know of related to these issues. Where is "independent" research proving all this is safe? The attitude appears to be convenience rules so do it first and if it's not safe deal with that later. Collectively there are so many of these electromagnetic and microwaves, coming at us all the time now. Qur cities just roll over and tell us it's perfectly safe and all they can do is make it look prettier with landscaping because the rest is out of their control. They belong to large organizations like the League of Cities that they could use to help with issues like this but that doesn't happen. Take Heed! I have read the story. I find Professor Smoller's resignation an attack on academic freedom. This is outrageous. Local politicians behind his resignation should and will be held accountable. Apparently, after seeing the incompetence of many state and federal elected officials as demonstrated by their total inability to solve urgent state and national issues , now we see hands of local elected officials who are attempting to obstruct citizen involvement in addressing local issues such as budget, compensation and need for small government on behalf of the hard working taxpayers. This is unacceptable and it should and must stop!

One would think we could manage our own property given that our two
locations are staffed with high paid professional management? Is Essex just looking for tenants or do they also manage the maintenance and landscaping for us? I wasn't aware we had so much vacancy at the Civic

With about 10,000 square feet of vacancy, I wonder what percent of the available space for rent is occupied? So we hire an Irvine based firm to represent us? If these services are really needed can't someone in Laguna Hills to do it? Maybe the good news is that we aren't slashing rents to get tenants at the expense of privately owned commercial property with vacancy?

City Manager, a City Attorney, a Deputy City Manager, a Community
Development Director and 20+ other full-time employees it is amazing
that we have to outsource our property management? What do they have to do besides market, answer questions about the property, show it to interested parties and negotiate the contract?

I have an idea. Don't keep vacancies a secret. Maybe they should be advertised as available on the City's Web

It's a sad commentary that our so many elected officials at the state and federal levels have disappointed their countrymen and women with their top three priorities, the priorities being reelection, reelection, and reelection to the detriment of the people, who trusted and elected them. Their perks must be good and perhaps that's why they want to hold on to their offices. This only means that we need to whittle those perks down. Their actions and lack thereof have put our states and the nation at peril for years to come. Now we are seeing that many of our local elected officials are not particularly any better. There are some gems like Barbara that we need to hold on to for the good of our people. People like Barbara care about the taxpayers, and are transparent and courageous enough to provide the leadership we need. Thank you for all the great work you are doing in shining the light on the local elected officials and their actions.

So Songstad, Scott, Lautenschleger and Channing finally won one! Terri Sforza’s column in today’s Register pointed out, albeit sadly, that fighting the establishment and city hall can be dangerous to your long-term employment health. Songstad’s darlings League of California

Cities and/or the Association of California Cities had enough clout with Jim Doti, the ever-political President of Chapman University,
to have Professor Fred Smoller demoted.

Maybe they’re correct: accountability, transparency and frugality really don’t have a place in politics, whether at the local, state or national level. And certainly, academic freedom has no place in an ultra-conservative bastion such as Chapman University.

Truly a sad day for we 99%ers.

Stealing You Blind" is the most important book I've read in a very long time. I strongly urge my friends to read it and pass it along. It's that much of an eye opener and removes any doubt that Obama and other big government politicians must be swept from office in 2012.

Regarding Professor Smoller, The very best possible scenario here is that he would be hired by a really good University for a Government Studies Program that actually encourages intelligent, creative thinking to solve problems in government. His basic belief in transparency and accountability appear to be perceived as far too radical for at least one small South OC City that was exposed related to its inflated compensation for its City Manager and Assistant City Manager and is apparently too much for Brandman as well. Why should students waste their time and money taking advanced studies at a University that will not allow them the freedom to learn the realities of how governments actually operate. Additionally, if the public really does have the most faith in local government they also better be paying very close attention to it to be sure they know what is actually going on. Jean Bland

Recent actions by the Laguna Hills City Council prove that they still don't understand the need to stop spending taxpayer money like drunken sailors. First, they vote to hire a property management company, to manage the maintenance of the Community Center and the City's Administrative Offices. This isn't "outsourcing" this is called "being lazy". The City has 20+ full-time employees, including a City Manager, an Assistant City Manager and a Deputy City Manager and everyone is apparently too busy to call an electrician to change a light bulb? The City can manage paving streets but needs to pay someone else to manage repaving their parking lot? Property Managers are for absentee landlords not owner occupants. This is a waste of taxpayer dollars.

One of the justifications for giving our City Manager a car that he can commute in is his need to be "on call" for 24-hours. "On call" doesn't mean calling the property management company because someone has reported a plumbing leak. Or can you imagine, if the City Manager walks into the office and the air-conditioning isn't working he calls the property management company and they call the air conditioning repair service. Why can't the City Manager just call the air conditioning repair service?

Next go to the City's website and look into Employment Opportunities. There is an opening for a new Community Development Director at $133,740 to $162,552 annually. Last time I looked our community was fully developed? Maybe the City's job should be to get out of the way of the private sector and not to attempt to control the private sector? Maybe the City Council's job should be to articulate a vision and let the private sector execute? I don't believe it is the public sector' job to tell the owner of the Laguna Hills Mall what they can or can't do with their private property. But this is one of the new challenges, the job opening suggests, the new Community Development Director will be responsible for.

A new job opening might have also been the time to start eliminating things like - 100% payment for health, dental and vision insurance; payment of the employee's 6.5% contribution to CalPERS on behalf of the employee, conversion of unused sick leave to cash, 4-weeks of vacation annually, 96-hours of paid holidays and an auto allowance. Again, no. All the outrageous benefits are still part of Employee Compensation. I want to know how many applicants there are for this position? The response will be very indicative of how competitive or uncompetitive the City's compensation package is. The system is broken and the existing Laguna Hills City Council is incapable of fixing it.

When I read the above comment about outsourcing the management of the Laguna Hills Community Center I had to laugh at myself because my expectations for many of the City Staff are so low that I immediately saw this outsource move as very appropriate. Following my low expectation logic I reasoned that the company to which management of the community center was outsourced would undoubtedly do a better job and is probably less expensive than the salary of a city staff member doing that job.

I never thought of someone on the city staff adding this job to what he/she is already doing because I read that at the last council meeting the staff couldn't even manage to "tweet" to citizens who had actually signed up for this service when the major power outage occurred in Sept. because their "tweeter" was on leave and there was no back up; the City sent mailed notices of a Tuesday meeting to concerned citizens regarding a public hearing on the Friday before the target Tuesday, when there was a post office holiday on the Monday before that Tues.; and staff had not yet bothered to advertise their apparently only once a year Pet Clinic that is happening on Oct. 22. I realize now that I am no longer thinking in terms of somebody on the staff doing a better job in the position they already have. Thank you for your message it made me think that staff could do better for the compensation they receive or the City could eliminate more of them and do more outsourcing.

Do you really think a City that can't uphold it's promise to tweet to residents who signed up for that potential emergency service because their only "tweeter" is on leave; can't get timely notices mailed to citizens of decisions that involve them; and can't think to advertise their once a year Pet Clinic enough in advance can think things through enough to handle more than they already have to deal with. Why not outsource the City Manager and Assist. City Manager. There are better managers in other small cities that may be willing to share their services.

But last week Smoller resigned as the head of program, although he maintains his position as a professor there. Smoller argues that the op-eds he wrote calling for the consolidation of Orange County cities and efforts by his students exposing the absurdly high compensation packages received by OC city managers angered the local political establishment. He said that Brandman officials succumbed to pressure from the Association of California Cities-Orange County, the break-away group from the state League of Cities, and essentially pushed him out. ACC denies any pressure, but it’s clear that the local city establishments, Republican and Democrat, were no fans of Smoller.

Smoller points to a meeting where Tustin Councilman Jerry Amante, Laguna Hills Councilman Alan Songstad and ACC CEO Lacy Kelly met with Chapman University President Jim Doti to in part discuss their concern about the compensation study. Amante told me Monday that “no one was seeking Fred’s resignation.” They complained about the appearance that Brandman was involved in a political campaign. Chapman seems to have taken a hands-off approach, as would be expected. But Brandman officials allegedly got spooked by the drumbeat of criticism.

Local government can be better than far-off government, but it also can be and usually is wasteful and tends to operate for the benefit of those who work for it. To spotlight inefficiencies and abuses in local government is not “attacking” the institutions of local government. That Amante and Kelly and other city advocates assert as much shows that they are about maintaining the status quo. Smoller said he has tried to engage ACC and other League of Cities types in arguments over ideas, but they don’t engage. Instead, they try to stifle.

In Smoller’s view, there are two types of people he finds involved in local politics and local government — defenders of the failing status quo who want to maintain their pensions, their power and their perks and those who want to have an honest public debate over the real issues. Those of us in the latter category might disagree vehemently over political solutions, but at least we’re not trying to protect the privileges of those in power.

Brandman, he said, has made a choice that it wants to be nice to elected officials and others who support the program. “I don’t give a darn about elected officials,” Smoller said. “I care about my students and teaching them critical thinking skills.”

On Oct 17, 2011 the Mission Viejo City Council considered An Ordinance to "Establish Our City Parks and Trails as CHILD SAFETY ZONES by Banning Registered Sexual Predators From Entering Our Parks and Trails Without Written Permission From the Orange County Sheriff"
With a vote of 5 - 0, they directed their City Attorney to model a “Child Safety Zone” City Ordinance using Orange County Ordinance No. 03-18-1 to 6 as the prototype. This Passed 5-0 with very little discussion.
